Terms of service.

These Terms govern your use of Locket. They form a contract between you and Locket Pty Ltd, a company registered in Victoria, Australia. Please read them carefully — by using Locket, you agree to them.

Acceptance of terms

By accessing or using Locket (the “Service”), you agree to these Terms of Service (the “Terms”). If you do not agree, you may not use the Service.

By creating an account, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.

Description of the service

Locket is a video-first recruitment platform. Candidates record short video introductions and create searchable profiles. Recruiters search those profiles, watch the videos, and shortlist candidates before scheduling interviews.

We may add, remove, or change features of the Service at any time. We will use reasonable efforts to notify users of material changes that affect their use of the Service.

Account terms

You must register an account to use most features of the Service. We currently authenticate accounts through LinkedIn. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Notify us promptly at hello@locketjobs.com if you suspect unauthorised access.

3.1 Recruiter subscriptions

Recruiter accounts are subscription-based. The subscription fee is AUD $200 per seat per month, billed monthly in advance, and includes access to candidate search, shortlisting tools, and direct messaging. Fees are non-refundable except where required by law. We may change pricing for future billing periods with at least 30 days’ notice; price changes do not apply to the current paid period.

3.2 Candidate accounts

Candidate accounts are free. You retain ownership of all content you submit, including video introductions, resumes, and profile data. By creating a candidate account, you grant Locket the licence described in section 5 so we can host your profile and show it to recruiters using the Service.

Prohibited conduct

You agree not to:

  • Misrepresent your identity, employment history, qualifications, or any other material fact;
  • Upload content that is unlawful, defamatory, harassing, discriminatory, sexually explicit, or that infringes the rights of others;
  • Use the Service to send unsolicited communications, spam, or marketing material;
  • Attempt to gain unauthorised access to the Service, other accounts, or the infrastructure that runs the Service;
  • Scrape, reverse-engineer, or extract data from the Service except via interfaces we expressly permit;
  • Use the Service to discriminate against candidates on the basis of any protected characteristic under Australian law; or
  • Use the Service in any way that violates applicable laws or regulations.

We reserve the right to remove content and suspend or terminate accounts that violate these Terms.

Intellectual property

5.1 Your content

You retain all intellectual property rights in the videos, resumes, and other content you submit. You grant Locket a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and share that content as needed to operate the Service and to make your profile visible to recruiters. You may revoke this licence by deleting your account, subject to the retention rules described in section 8.

5.2 Our service

The Locket Service, including all software, design, text, logos, and other content created by us, is owned by Locket and protected by Australian and international copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.

Disclaimers and liability

The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

Locket does not employ candidates and is not a party to any employment relationship that may result from use of the Service. Locket does not warrant the accuracy of information provided by users, the quality of any candidate, the legitimacy of any recruiter, or the outcome of any interaction conducted through the Service.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.

To the maximum extent permitted by law, Locket’s total aggregate liability arising out of or relating to these Terms or the Service is limited to the greater of (a) the fees you have paid to Locket in the 12 months preceding the event giving rise to the claim, or (b) AUD $100. In no event will Locket be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill.

Termination

You may close your account at any time by emailing us at hello@locketjobs.com. We may suspend or terminate your account at any time, with or without notice, if we believe you have breached these Terms, used the Service unlawfully, or if we discontinue the Service.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or as necessary for legitimate business purposes (for example, fraud prevention or financial record-keeping).

Governing law

These Terms are governed by the laws of Victoria, Australia. You and Locket agree to submit to the exclusive jurisdiction of the courts of Victoria for the resolution of any disputes arising from these Terms or the Service.

Changes to these terms

We may update these Terms from time to time. If we make material changes, we will give you at least 14 days’ notice — by email to the address on your account, by a notice inside the Service, or both. Your continued use of the Service after the effective date of the updated Terms is your acceptance of them. If you do not agree to a change, you may close your account before it takes effect.

Referral offer

We run a referral offer that pays cash to people who refer a recruiter to Locket. It is a separate promotion with its own terms, which cover eligibility, what counts as a qualifying hire, how and when we pay, and our right to change or withdraw the offer.

Read the referral offer terms. They apply in addition to these ones, and where the two disagree about the referral offer, they prevail.
